Revised Discovery Procedures for Patent Litigation in the Federal Court of Australia

The Federal Court of Australia has outlined refined discovery procedures for proceedings under the Patents Act 1990 (Cth).

Discovery

4. Before discovery is ordered, the parties must confer to discuss the issues to be addressed by discovery and the nature of the documents sought, and whether evidence should precede discovery.
