Media Report - Victoria sets timetable for civil reform
May 22, 2009 Media Report from The Australian:
Victoria will have a new civil procedure act within 12 months aimed at promoting the "just, efficient, timely and cost-effective resolution of disputes", Attorney-General Rob Hulls revealed this week.
Mr Hulls said an advisory committee chaired by Chief Justice Marilyn Warren had been working through the landmark civil justice report that was delivered in May last year and contained 177 recommendations.
Barrister and academic Peter Cashman pushed for "overriding obligations" and codes of "sensible conduct" and Mr Hulls confirmed they would be part of the new act.
For example, all parties to litigation will be required to act with candour and honesty and help avoid delay through the early disclosure of their case and provision of documents. There will also be much clearer case management powers, including time limits on cross-examination and on closing arguments.
