Media Report - McClelland wants cheaper, faster Federal Courts

Media Report from The Australian:

THE Rudd Government will use the pending restructure of the federal judiciary to promote a "quick, efficient and inexpensive" philosophy across commonwealth courts.

Attorney-General Robert McClelland this week announced the Federal Magistrates Court would be dismantled, with the family law division becoming part of the Family Court and the general division folding into the Federal Court.

Mr McClelland is also planning to amend the Federal Court Act and introduce an overriding purpose provision that will bind courts, parties and their lawyers.

The provision will ensure those involved work "towards the just resolution of disputes as quickly, efficiently and inexpensively as possible".

The NSW Supreme Court Rules talk about the "just, quick and cheap resolution" of disputes but this is believed to the first time it will be written into legislation. Federal Court judges will also be given additional case management powers and there will be cost penalties for those who do not comply with directions.
